1. TERMS OF SERVICE & CONDITIONS

These Terms of Service (“Terms”) govern your access to and use of the Swag Bag Events website (“the Site,” “we,” “our,” “us”). By accessing, browsing, or using any part of the Site, you agree to be bound by these Terms and all related policies.
All services, pricing, policies, features, promotions, and affiliate commissions are subject to change at our discretion at any time without notice.
If you do not agree with these Terms, you must discontinue use of the Site immediately.
1.2 Eligibility
• Users must be 18 years of age or older.
• Users must register an account to access certain restricted areas, including Swag XXX.
• Users must confirm age authorization before entering any age-restricted categories.
We reserve the right to approve, deny, or terminate accounts at our discretion.
1.3 Use of the Site
Users must not engage in:
• Illegal activities;
• Fraud, misrepresentation, or manipulation of services;
• Uploading harmful, malicious, or offensive content;
• Violating intellectual property rights;
• Using the Site for solicitation of illegal services.
Violation may result in immediate account termination and possible legal action.
1.4 Vendor Registrations & Promotional Pricing
Promotional Packages
All promotional pricing, discounts, offers, or launch specials are:
• FINAL SALE,
• Non-refundable,
• Non-transferable.
In rare special circumstances, a refund may be considered; however:
• Any approved refund will be issued as a credit on file only,
• No monetary refunds will be issued for promotional pricing.
1.5 Affiliate-Linked Vendor Registrations
If a vendor signs up through an affiliate link:
• No refunds will be issued under any circumstance,
• Only a credit may be considered due to commission payouts.
This policy overrides all other refund rules.
1.6 Regular-Priced Vendor Registrations
For vendor packages purchased without any affiliate link:
• A 7-day refund window applies,
• Refunds apply only to regular-priced services,
• Refunds may be subject to administrative or processing fees.
All refund decisions remain at our discretion.
1.7 Service Modification & Discretion
We reserve the right, at our discretion, to:
• Modify content, pricing, or services;
• Suspend or terminate platform features;
• Restrict access to any part of the Site;
• Adjust or discontinue promotional offers;
• Update or replace any policy at any time.
1.8 Limitation of Liability
To the maximum extent permitted by law:
• You use the Site at your own risk.
• We are not liable for direct, indirect, incidental, consequential, or special damages arising from your use of the Site.
• We do not guarantee uninterrupted service, error-free operation, or security of data.
1.9 Termination
We may suspend or terminate any account, with or without notice, for violations of these Terms or for any reason deemed necessary for platform integrity.
2. AFFILIATE MARKETING PROGRAM POLICY
2.1 Eligibility
To participate in the Affiliate Program:
• You must be 18+;
• You must have an active social media page, website, or audience platform;
• We may approve, deny, or remove affiliates at our discretion.
2.2 Commission Structure
Affiliates earn:
• 33% commission on new vendor registrations, and
• 33% commission on vendor renewals at full regular price.
Commissions:
• Are paid in CAD funds,
• Are issued every 2 weeks,
• Are based on completed transactions only,
• Are subject to change at our discretion.
2.3 Cookie Tracking
Affiliate referrals are tracked using a 30-day cookie window, unless modified.
2.4 Minimum Payout Threshold
The minimum payout is $100 CAD, unless updated.
2.5 Prohibited Affiliate Conduct
Affiliates may NOT:
• Generate fraudulent signups;
• Use spam, bots, or unauthorized advertising;
• Misrepresent Swag Bag Events;
• Use misleading or deceptive practices;
• Engage in unethical or illegal promotion.
Violation may result in:
• Loss of commissions,
• Program removal,
• Account termination.
3. REFUND & CANCELLATION POLICY
3.1 Promotional Purchases
All promotional packages are final sale with no refunds.
3.2 Affiliate-Linked Vendor Purchases
If a vendor registered using an affiliate link:
• No monetary refunds will be issued,
• Only credits may be considered.
3.3 Regular Pricing Refunds
For regular-priced packages purchased without affiliate involvement:
• Refunds available for 7 days after purchase,
• Refunds may exclude processing fees.
3.4 Credits
Approved refunds (if any) will be provided as store credits only.
3.5 Discretion
All decisions regarding refunds are made at our discretion.
4. SWAG XXX AGE-RESTRICTED POLICY
4.1 Age Verification
To enter or access Swag XXX:
• Users must be 18+,
• Must verify age,
• Must maintain an active registered account.
4.2 Prohibited Content
Strictly prohibited:
• Sex work or solicitation;
• Escorting or prostitution;
• Human trafficking or exploitation;
• Pornographic content involving minors;
• Non-consensual or coerced content;
• Violence, exploitation, or harmful content.
Violation results in:
• Immediate account suspension,
• Permanent removal,
• Reporting to relevant authorities.
4.3 Reporting Misuse
Users must report any:
• Illegal content;
• Misuse of the category;
• Suspicious or harmful activity.
4.4 Liability
We are not liable for:
• User-generated content;
• Misuse of the platform by any party;
• Harm, damages, or losses resulting from user actions.
5. PRIVACY POLICY

7. GOVERNING LAW & DISPUTE RESOLUTION (ONTARIO)
This Agreement is governed by the laws of Ontario, Canada.
7.1 Mediation
Any dispute arising under these Terms must first be submitted to formal mediation in Ontario.
7.2 Arbitration
If mediation fails, disputes shall be resolved through binding arbitration in Ontario.
7.3 No Class-Action Waiver
Per your instruction, users retain the right to participate in class-action matters where legally permitted.
